Sure it's DDos...they just fake Player numbers and on Patch day they have massive problems with real 7-9k players. And DDos is the standard excuse when they can't stabilize the server. And when someone DDos the server, he will DDos it all the time and not only on Patch day^^ the same was on TBC release.
