WotLK Ninja looting rule question

Hello, can someone clarify :
In the rules it states that

- Player need rolling (group loot) on items which he cannot even use.

so when I'll press Need on a piece of gear that I can roll, but it's useless on my class - that makes me a ninja looter? (Even if I don't win that piece)

I'm not a GM but that sounds like a pretty gray area that would be up to whoever receives the report. But coming from someone who would rather put the loot on FFA than deal with the whine flavor of the day, if they didn't steal it then I really don't care.
