On my 63 rogue i saw this guy was ?? lvl for me, then checked the armory and he is 73

Sounds like he queued then leveled while the bg queue stayed.

Yeah you just queue up and then during the queue you level up, people would do this intentionally on older versions of retail as well, usually at levels with big spells/gear increases to be as strong as possible.
