No, he will be banned if reported properly. You need to ask the group if you can roll ms dps and they have to agree, you cant tell the group you're rolling ms dps
Also, everyone in the group NEEDS to say "Yes, you can roll". If somebody is silent it doesn't count as "Yes" and he can't roll the other spec.
