this to me is one of the scummiest things to ever happen, so tldr i was doing RS 25, and this person (i will not comment on performance) rolled MS and won the cloak, i couldnt check if he had better or worse cloak but it doesnt matter, is this okay? is this appropriate? is this even allowed?...

I cant say for sure.. It depends on the rules set down from the raid leader. If the Piece was won by fair means I guess he can do with it as he pleases but yes this turn of event doesn't sit right with me either.
Hi. I saw the name of the mage, looked it up on the armory, turns out he already had bis cloak (the hc one), but some of the people in that guild do these things frequently. While in pugs, they sometimes equip other items so they can roll and then try to sell the items won to other people for gold. They figured out some way to avoid getting banned for ninja looting this way from what I can tell
Taking items when you already have an equal or better item is a good example of taking something you don't need. I'm sure they would be handled with a proper report. This is actually one of the examples for ninja looting.

check his logs on uwulogs there u see his gear during the raids easy to tell if he has it
