Question about NINJA or NOT

Situation is:
[Sabatons of Ruthless Judgment] 245 iLVL dropped
(Mail +94Agi +80Stam +53Int 1Socket +119AP +53Hit +67Arp)

Paladin with
[Hellfrozen Bonegrinders] 264 iLVL
(Plate +121Str +137Stam 2Sockets +64Crit +80Arp)
rolled those 245 boots and said that he will report RL if he wont give them to him.

Hunter from this raid rolled too and he really needed this 245 feet.

Question is:
Should RL give 245 boots to pala or no?
I ask answer from people who REALLY know the server Rules.

I forgot to mention that Paladin said he needs hit rating, thats why he wants theese 245 boots.

Rules say:
"- Player need rolling on gear which is clearly worse than what they had before, despite being for their current class and role" is a ninja move.

Did he get the item in the end? Who else rolled for it, and what is your item to be upgraded from?
Ninja? Yes, clear as day. 20 ilvl lower and if he wants hit so bad, tell him to gem into hit. Its piss-easy to hitcap a retpaladin. I would report in your place. But if you dont have several screenshots, inside the dungeon and exactly when it happened, he will be free of any consecuences.

Paladin's roll should be treated as OS roll, not MS roll.

1. It's worse than what they have currently in terms of ilvl.
2. It's mail, not plate.
