In my opinion, if there was no agreement on who would take the mount, then whoever takes it can do whatever they want with it.
It depends fully on the wording of the agreement. In most cases a sold "run" stipulates in clear terms if the one buying it will get the loot or not.
Of course that's only as far as getting official punishment goes. The word can still spread among the community that the one running it is a scammer for selling a boss run and then using a badly worded agreement to keep the drop in bad faith.
Would you consider it a scam if the guy won the mount and then tried to pay you with warmane - frostwolf gold? it was only agreed that he would give you x k gold, not that it would be on the server you two play on
Seems like your intention is to mislead. Is it technically scamming? Guess not, but like Allylilith mentioned, it can go two ways. Would you feel scammed?
In spirit, this is scammer behaviour.
If your intention is not to "scam", you wouldn't leave out the part where you intend to need ot it, because you know fully well that that is the assumption they're making when buying a summon service.
