Ninja Looting clarification

So I got banned for ninja looting in HC. However I don't quite understand the reasoning behind it.

I only need off-spec items after consulting first with the party members if it's ok for me to take the item
If everyone agrees I need it.
Happened once where one player did not answer, he needed it, I won the item. But I immediately traded the item with him.

So my question is, how can this be considered ninja looting if I got permission from all party members to take the item?

I've appealed, but no answer for more than 8H ..

You need explicit permission from all of them. If one player does not reply, it is best to greed it.
In fact I'd say it's best to always greed and then ask the winner of the roll if you can have it.

The example of a player not replying happened once, and I gave him the item immediately. There was no complaints from anyone, he even thanked me for it.
On the topic of always greeding, that makes no sense whatsoever.. if everyone agrees why the need to greed? Just wastes everyone time.
Additionally this was my first "offence" so I never got a warning or anything.
I understand that the moderators have tons of work, but banning just for the sake of it is unfair.

It’s clearly stated in the rules: if you ninja an item in a dungeon, you receive a 5 days ban (and longer if it happens repeatedly). What else would you expect? That a GM whispers every first-time ninja looter with something like "Hi, please don’t ninja next time or you’ll be banned" or sends a mailbox warning? If that were the case, everyone would just save their “one free ninja trial” for a valuable item, knowing they’d only get a warning the first time.

I can’t say for sure if this particular dungeon run is what led to your ban, but waiting 8 hours without a reply is completely normal. Response time is usually between 1–3 days. The best thing you can do now is wait for the GM's reply through the official support page: https://www.warmane.com/account/support and I hope they provide you with some details as well, just to give you a better understanding of the situation.

Right, but I never Ninja'd an item. Like I said in my first comment, I always ask for permission before needing an item. I never received any complains from anyone. This was unjustified.

People don't need to complain to you. They can simply report you without telling you.

If it was unjustified it's sadly your duty to keep track to people agreeing to you needing for non-mainspec items. You can provide support with a screenshot of everyone agreeing then.

But your story already shows you don't wait/ask for everyones permission and need on items and return them afterwards. Even if you return the item it doesn't change you needing on items you're not allowed to and thus, by definition, ninjaed it.

Yeah, but one person not answering is enough. In your example you did ninja loot. It may not have been that case that got you banned, but other, similar kind one.

Greed and asking later makes perfect sense, at least when there are no enchanters to allow disenchant roll. Greed roll can never get you banned for ninja looting. I find the process of asking for permission to need an item for OS has too many things that can go wrong. And RDF items aren't worth it in my eyes.

What warning you can get is you appeal your ban, and they lift it.

That's quite false. I asked GM in ticket multiple times during my playtime here and the responce was simple: ALL players must agree. Same for MS change in dugeon - all players must agree. If one is not responding - it's not valid.

If a hunter who is decked in epics roll a blue 1 handed item is that considered as ninja?

Since he doesn't intent to use it for intended purpose, deal damage with it (and even if he does, he got a better one already), then yes.
