fyi just in case no one mentioned it (didnt read the whole thread) abandonware has nothing to do with why blizzard has taken no action, its the different laws in eu(not regarding abandonware) why they are still somewhat safe, this might and probably will change once the transatlantic trade agreement has gone into effect.
I'm not sure this is the case here, we used to play on Molten WotLK while it was running on retail, although we were always 1 or 2 patches behind, but we were on the same expansion. I think legally there are plenty of terms that have to be taken into account not just being on the same expansion/patch or whatever.
Actually, Warmane, (molten) has an agreement with Blizzard that gives Molten the services to run it's servers. Blizzard won't sue Warmane unless the agreement is broken. I'm not sure the details of the agreement but it is in place.

I'm CEO of a multi-$m tech company, have built many previously even bigger than this, and know plenty about tech/software IP.
The fact that warmane is not shutdown has NOTHING to do with it not having a WoD server.
It has to do with where they host the servers for warmane which I believe is in Russia.
It also has to do with the jurisdiction where they host websites, payment processing, and all their assets (banks accounts, registrations, etc).
ANY server, even a classic wow server on version 1.0 will get shut down if its being hosted in the US and gains any tractions.
This has been happening for YEARS and will continue to.
Now it is fair to say that ANY server that gains allot of traction and publicity is going to get blizzard to take a look at trying to shut it down.
There used to be MANY really big servers which were prosecuted very smartly by blizzard even though they were hosted in places like amsterdam (holland) and various other very safe places with strict liberty laws.
They were not using latest expansions, but they had upwards of 50k active players at once and this is a direct reduction of paid customers in blizzards eyes so they evaluate how much it costs to take down a server versus how much they are losing in potential retail sales because of the playerbase there.
THIS is how you do legal prosecution work and protect your IP. Fortunately some countries dont cave in to draconian IP laws which much of the western countries are subscribed to. Even as a tech CEO myself owning IP which I regularly protect - I dont believe in forcing people to pay for licensing usage of a piece of software that they have already bought. I believe we as consumers should be able to chose. Therefor I not only play on molten (err, warmane) but have donated more here than I ever paid to blizzard, while playing there for a good few years on multiple accounts.
Because I chose my service and warmane provides the service I want as a customer. Simple as that.
If blizzard wasnt so stupid they would actively allow private server hostings and setup a kind of affiliate program where they provide support and tools in exchange for a small profit share fee.
