Considering we are not allowed any personal items on us at work (Waitress) or smoke in public at work, there was no way it was a staff members.

This whole argument is ridiculous. Nobody really cares that you stole the game card. The fact is that you did something wrong and you're justifying it. Mistakes happen, and the majority of people are going to do something dishonest at some point in their lives (nothing as extreme as stealing or whatever) but you take responsibility for it.
