It clearly states "Equip: Increases defense rating by XXX". You couldn't miss that.
Yes, you could get banned if you needed item that's not for your class/specialization. You are DPS and you needed a tank item. If you didn't get it you probably won't be banned, if you however got the item and if he reported you you'll get banned for "ninja looting in dungeons".
If you could've seen the item has strength and stamina then you could've just as easily seen the green letters beneath it saying it has defensive stats.
The first ban is 5 days.
