I've always seen Pay to Win as gaining anything that affects gameplay regardless of whether you can eventually get it in game or not. Some people think pay to win should only apply if what you are buying gives a massive advantage rather than a minor one, so I'll respectfully disagree. Although to quote Urbandictionary
"Games that let you buy better gear or allow you to make better items than everyone else at a faster rate and then makes the game largely unbalanced even for people who have skill in the game without paying."
Having said that, there is so much negative associated with the phrase "Pay-To-Win", that you can rarely having any meaningful discussion around it. So I'll just state the facts for the OP.
In the store you can buy gear that is item level (ilvl) 200 and below. In game the current highest ilvl is 213 and 226. Now when the next tier of content (Ulduar) comes out and is cleared enough, ilvl 213 gear will become available in the shop, because now the highest will be 226 and 232. This will continue until Icecrown Citadel and Ruby Sanctum (ilvl 277 and 284) where upon the highest ilvl gear you can obtain in the shop will be ilvl 264 and 271.
You can decide for yourself if that is "Pay-To-Win".
