WotLK client tries to update to 4.0

i fire up the client and on character selection screen it says "downoading update". to continue it requires q restart. i press restart and it starts the patch downloader, as saying: "downloading 3.3.x-to-4.0.0-patch-NA"

and it does not download anything: "the tracker is not responding"

what m i supposed to do?
