I suggest interacting with friendly players who are marked no longer spreading the mark to others. It's ridiculous for a duel to spread the PVP mark to me. I haven't engaged in hostile PVP.

Then the requirement to obtain the mark should be:
1. You attack the opposite faction.
2. You heal someone who has the PVP mark. Maybe even include a proximity to hostiles for the mark to apply (120 yards?)
I deeply love PVP in every form, but obtaining the mark from something like using a Shadow Crystal Focusing Lens on a friendly, then having a wpvp raid run in and wipe me moments later is kinda silly and obnoxious. Surely it can be refined to apply the mark more appropriately.
Or here's an idea, if you know there's a raid coming and you're not yet pvp flagged, don't do anything that you already know would make you flagged. Those proximity filters are silly and would still get abused.
