If you were the raid leader - have you specified that BoE are reserved and are able to prove it? No - the ban is justified. Yes - the ban is not justified.
If you were not the raid leader (Need/Greed system, dungeon or whatever) and you pressed Need on it without the item being an upgrade for you - The ban was justified. You did not need the item, you were greedy for the gold.
If you were not the raid leader in a master loot setting and you got the item from the master looter - unsure. Could be considered cooperating if you decided to keep the item, perhaps, but can't give a definitive answer.
'Binds on Equip' items get the same treatment as 'Bind on Pickup' items. They are to be rolled MS>OS unless stated otherwise in raid rules before raid's start.
In RDF it's MS>OS. If the player rolls need for BoE item and they have better item, that player can be reported for ninja looting. Or any other player when the item doesn't fit their roles.
