Background: I just had an encounter with an unfortunate pug Icc 10 group on horde on Icecrown WOTLK where an item was taken from me. Here's the scenario (as I wait with GM ticket open)
Scenario: I'm a warrior tank, rolling MS dps as I stated from the start and lead announced confirming my spec change. On Marrow, I rolled Offspec for tanking choker and won. On Gunship 10hc, I tanked the mobs on our ship. After the fight, Saronite Gargoyle Cloak Hc dropped and I won with a Main spec role of 90.
The case: The leader, a frost dk, claimed that the cloak with crit+haste stats is not for warrior. He was wearing Shadowvault slayer cloak (agil crit haste 25n gs) and I Relentless Gladiator's Cloak. Now, I realize that for a warrior the EoF cloak is better. However, as I have a pvp cloak as the alternative, I very much needed this pve cloak. In addition, the EoF agil arp cloak is better for both classes.
After arguing that starting off claiming I rolled main spec for the marrow neck, to accepting I came as dps but it's not for warrior, the leader took the cloak and started the next fight. My ask is, logically, what should have happened here?
The item is obviously dps, regardless who needs it more, by the standards of icecrown, you won the roll for it and you can surely use it. RL has no right to call out who needs the item more on a pug run, only guild runs, therefore, a ninja.

If we were lawyers arguing this in court i would have to agree with this. However that not being the case although it is ninjaing its mitigated by the fact that the item is not as gd for you and another one easily obtainable. Well i know how slow farmin eof but..one useless stat for another (resilience-hast) is not rly worth it, get wrathful cloak. So tho he should have given it to you, not worth being pissed that he didnt.
Similar fights always ensue to mages/locks/spr rolling gear with spirit as they get small benefits from it too and being able to win over healer priests/dudus.
Most leads in this case may prioritize heals. Not legally correct as it might be better than their existing gear but they have other alternatives unlike the healer.
u get the point. (i actlly made a full spirit demo lock to test buff difference but nvm :))
It was a dick move for the RL to take it for himself, when he already had a PvE cloak, and you were using a PvP cloak.
When I lead / lootmaster, and it comes down to that scenario, unless it's a huuuuuuge upgrade for the already PvE-equipped player, the player with the PvP gear is going to get it, since everyone is going to benefit more from that player having actual PvE gear in a raid.
With it being a pug, it's a little bit more of a gray area, but in my honest opinion, it was a dick move for the RL to use that rationale to just take the gear for himself instead.
Also wanted to add before I forget, I'm a big proponent of : Play the spec that you want gear for. I don't really agree with people playing one spec in a raid, but rolling for their offspec, when there are people playing their main specs already, who are there for that gear specifically.
It doesn't seem fair to me, and never really has.
If you want gear for a particular spec, you should be playing that spec. And if you don't have enough gear to be raiding in that spec, well, go grind out some EoT gear / EoF gear until you do, since it's not really fair to the players that are playing that spec in the raid.
