I believe so, since they have different item IDs. Not 100% sure though. I could have sworn I'd heard of players using norm + heroic versions of items at the same time. (Trinks, though.)

For ICC Items, you cant use the same item once normal once heroic.
This works for the drops from ToC though, as you might see people running n+hc DC/DV or n+hc Solace. (never seen double reign though, would be interesting to see if the ICD on gaining flames is fixed)

You are correct. Blizzard made this change going into ICC after seeing how powerful doubling up on certain items could be.
