The hit cap for yellow strikes is 4% for melee, ranged and spells.
However, you always have a 1% chance to miss with any ability or spell in Vanilla/TBC.
Also, make sure you take talents and resistances into account.
That's PvE, he asked for PvP. However you are correct that it is 8% for PvE. :)

not true at all, its 5% hit for melee in pvp and you always have a 1% chance to resist spells in tbc. the only way you miss specials above 5% hit in pvp is if they're wearing +defense gear or have talents for increased miss chance.
Edit: Did some testing and it seems they have fixed the hit. However it seems certain melee abilities are counted as spells.
