While it is a torrent download I don't think its considered illegal. But your best bet might be asking your ISP directly, they won't lie to you.

Use direct download instead of torrent. You can try the ones in this thread. In Germany torrents are heavily monitored. If someone associated with Blizzard doesn't like it, you can get a warning or a fine.
