WotLK Needing on OS

So I was recently banned for mistakenly needing on an item I didn't need so ever since I have been overly cautious on needing on anything that I feel like could get me banned, even though I do NEED an item i sometimes don't need because the other person might need it more. After hearing how extremely strict the rules seems to be on ninjaing I am curious how the GM's look at needing on off spec gear.

If a retribution paladin were to make a ticket towards me needing on, lets say a tank shield (we both needed on) while I am a Holy paladin, will that get me banned?

Because if an incompetent or lazy GM looks at the ticket they could just see it as I ninjad the shield because I don't need a tank shield as a Holy paladin.

After getting banned for an extrelemy small thing I am now barely needing on anything that I feel could get me banned. So in this scenario I wouldn't even need on the item.

so needing on a tank sheild as a healer could indeed be seen as a ninja.
