If an item drops, and someone needs it for disecnahnt, and he chooses Needs instead of disenchant, is it considered as ninja loot?

If yes i would like to report a Druid who just needed an item, 200 ILVL while he had 264, only to make it dust, and then he kept asking me Why i am mad? and its not illegal

That's something you're better off asking a GM directly with an in-game ticket. They're the ones who make the call on specifics like that. Personally, I'd say it is, since the Disenchant option would be there, but he avoided the competition that would come from it by using Need, and that's not the purpose of that. Still, it's the GMs who decide.

Just go ahead and report. Need is for gear upgrades for the chosen role and/or spec. Not to fatten your professions or gold balance.
